Loss of Income & Earning Capacity

Out-of-pocket expenses incurred as a result of a person's injuries are recoverable as "special damages."

Common special damages include medical treatment expenses, mileage relating to medical treatment, childcare costs, gym memberships, ergonomic office equipment, and the installation of home modifications such as stair lifts or shower bars.

It is important to keep receipts for all expenses. Before incurring a significant expense, speak with a lawyer about your likelihood of recovering the expenses by way of special damages.
