Our library contains very general information about various areas of the law. It is written by lawyers who are listed in our directory and provide legal coaching or limited scope legal services.

We're continuously adding to this Library, parts of it may be incomplete.

Alberta Child Support Recalculation Program

The Recalculation Program can update court orders used with the Maintenance Enforcement Program.

If parents aren't using MEP, they can choose to recalculate by agreement.

Failing to recalculate when an order or agreement requires you to, or requires you to exchange financial disclosure each year and you don't, might result in Retroactive Adjustment to Child Support back to the date of the breach, which could result in many years of arrears.

The Recalculation Program recalculates support as of the one-year anniversary of the last court order. A court application to vary child support can be brought sooner if there has been a significant change such as a loss of a job, promotion, or other significant change in income.

All child support orders must state whether or not the Recalculation Program will be used. The Recalculation Program may not be appropriate where:

  1. Either parent receives Self-Employment Income;

  2. We're Imputing a parent's income;

  3. There has been Undue Hardship; or

  4. The parents have deviated from the formula in the Federal Child Support Guidelines and have implemented their own calculation.
