Pay for the hours worked or due to me.

I am currently having issues with payments, regarding from both parties, Wcb and Air Canada. Air Canada claims that they had forgotten to pay me on August 2 proceeded to pay me August 16 and I have still yet to see a pay statement or a pay from August 2. I have emailed multiple people multiple times spoken to multiple different people from HR and from my branch directly I’ll keep telling me that they are going to check in to see what days I work that they miss paying me for not have them getting back to me in now over two weeks. As for WCD it is also a problem of pay WCB required me to stay off of work until July 15 and claimed that the benefits I had put them ended July 14 however when my union reps and I decided to call and see why I hadn’t been paid for the two weeks prior to from June 27 to July 14 they cannot clarify a proper answer and refused to pay me as they declared I would have to pay them back. They equally made me take off July 24 off of work to go to a doctor appointment they had set up. I ended up driving just a doctors appointment on July 24 which was 40 minutes away from my house just for them to tell me and Wcb went behind my back and cancelled set appointment, I would like to also declare the Wcb has had the worst communication I have ever seen in my life and had made me paid for my previous appointments on my own as they were unable to provide me with the information needed to go see one of their doctors, and were unable to provide me with pay for over a month as they could not communicate with me I kept trying to call and email no answers gotten back to me. Once I had this problem on July 24, I tried contacting the supervisor of my case manager, and she refused to speak to me and had my case manager be the messenger and go between her and myself telling me or trying to explain to me what had happened. They also misdiagnosed me which now still leaves me in pain, and failed to communicate with Air Canada as well. I am just trying to get compensation for the hours I am owed from both WCB and Air Canada.

I am unclear about the hours you mentioned that you are owed from WCB. This would likely require a further discussion about the specific circumstances. However, I will provide some general information that may apply to the WCB issue and more specific information about the employer.

From what you have said, WCB may believe that is your employer's responsibility. You could ask them again to encourage the employer to pay. Alternatively, ask them to put their determination that the employer is responsible for paying these amounts in writing and give it to you. This would support and Employment Standards complaint regarding these hours.

You may also appeal a decision of the WCB, and you should contact them as soon as possible if you wish to do this. There may be very short amounts of time in which you can appeal. I can't say based on the information of this is the best course.

For amounts owed by the employer. I am assuming that you are not unionized. If you are unionized, you should be speaking with your union steward or representative. If you are not unionized, you can file an Employment Standards complaint about unpaid wages, and they will investigate and determine if you are owed the amount.

It is important that you know that you must file an Employment Standards Complaint within six months of the issue you are asking them to investigate. After six months it is likely you will no longer be able to file a complaint.
