Our aunt passed away with a will with a single beneficiary our uncle. The law firm handling the case did not file for a grant of probate. This is the case despite the fact that there was assets in a foreign country that needed to be distributed to her husband. We have searched and there is no Grant of probate on file with Alberta services or the court. What is our course of action as we do need a grant of probate?

It appears that your matter will require legal advice specific to your situation. If the law firm handling your case cannot assist you further, you will need to contact another law firm.
Because lawyers need sufficient information to be able to provide an opinion, and to be able to ask you questions (which usually means at least a half-hour consultation), the lawyers here can only provide basic information and answer very general questions.
