Consent to Waive Bond (GA14)

Cassidy (Leduc)

My brother and I are co-executors for our late mother's will. She resided in Alberta and we're both in BC. We're also both the residuary beneficiaries (though some other family members are named in the will for specific gifts). I am planning to file the application for probate, and not sure how I have him fill out the GA14 form. Where it says "Sworn or affirmed.... in ____ Alberta", does that mean he would need to sign the form in the courthouse in Alberta? The regulations state that the applicant can file the consent of a beneficiary, so is it me swearing the form is true instead of him (the Deponent?). Also since I'm also a beneficiary, can I file my own consent to waive bond as well? Thanks.

You can have your form sworn in BC and just cross out "Alberta" and put the city and "British Columbia" on the jurat . If you are swearing/ affirming in BC , be sure to use a Notary Public and have the document notarized as you are outside of the Province of Alberta. Alternatively if you are coming to Alberta, you can swear a document before a Commissioner for Oaths in Alberta. As for your consent to waive a bond, if the Beneficiary is the deponent, they must swear the Consent. I suggest two people can swear the Consents, one each. Otherwise you can swear a document "Jointly and Severally" if you know how.
