The will must be followed. If the will states assets will be split between two brothers, then they are both beneficiaries.
This is a bit confusing - where is the one brother listed as beneficiary, if the will states that the assets will be split between two brothers? Note that some assets don't form part of the estate, and may not be governed by the will, depending on how the will is drafted - for example, RRSPs with a designated beneficiary generally will not form part of the estate (there may be exceptions, and you should ask a lawyer to review the will and any assets with designated beneficiaries). This is a difficult question to answer without specifics.

the assets are 3 registered accounts, one is a tax free account. my brother is listed as beneficiary, yet both of us are listed on will to split equally. with these 3 accounts can any money be taken out before estate is finalized, something like interim distribution
