Grant of Administration

Charlene Vance (Medicine Hat)

I recently received a letter from the Office of The Public Guardian and Public Trustee stating that I (or someone in the family) needed to apply for a Grant of Administration for our late sister's estate (she passed away without a will). Our sister had developmental disabilities and was in care her whole life. Because she was estranged from the family for all these years, I was shocked to receive this letter now, advising we needed to apply for a Grant of Administration, to look after her estate. I presumed The Office of The Public Guardian and Public Trustee would automatically deal with this because she was a client of theirs for most of her life.

Do I go ahead and apply (and pay for) a Grant of Administration on my own? Is this a situation a person can navigate on their own (because the estate is small/simple), or should I retain a lawyer to handle everything, because of her special circumstances? I appreciate your help with this. Thank you.

You can likely do this on your own, but because your sister was a client of The Office of The Public Guardian and Public Trustee, I would reach out to them first for clarification and guidance on next steps.
