Can I sue my condo board in Calgary's Small Claims Court, (Alberta Court of Justice Civil Claims). They filed a wrongful caveat against my home after giving me a plumbing chargeback that was not my responsibility. It has caused financial damages. I've been told that if I want the court to order the caveat removed I need to file in King's bench court but I really want to avoid that if possible. Can I sue for damages in small claims court. Or maybe pay the bill and late fees and cost of them filing the caveat first and then sue for damages? They turned a small $450 bill into a $1400 bill and a caveat on my home without contacting me or giving proof of damages. There were no damages and I've written them 8 times over 6 months with no reply. 6 mails before they filed the caveat went unanswered. Thanks. This has been a nightmare.
