Mary (Edmonton)

How can a victim of domestic abuse who has been granted an emergency protection order from Alberta move with her child to another province before settling or filing any divorce, separation, or custody agreements?

Hi Mary,
The short answer is you can't. The long answer is that you have to make a mobility application to get Court permission to take the children out of Alberta without the other parent's consent. There are multiple options in between. I strongly recommend that you meet with a lawyer to discuss the specific facts and nuances of your particular situation to determine the best path forward for you and your family.
