Joint loans in speration

Michelle Chevrier (Edmonton)

My ex and I were in an adult interdependent relationship. Had to sign paperwork. My question is he has gone to his bank and put a stop payment on our car loan and my car insurance.
We have been together 6 years. We have a 4 year old soon to be 5 in April.
I have not worked since we have been together cause he would not let me. Abusive relationship.
So the car payments and car insurance comes from his bank account cause I have no income.
The car is registered and insured in my name only cause he doesn't have a driver's license.
So my question is does he have the rights to just go a mess up my credit and screw with my insurance .

Hi Michelle, what do you mean by having to sign paperwork? If you signed something like a Cohabitation Agreement then that might replace the usual rules.

Family law can't remove you from a loan or force him to pay insurance, but if you haven't given up the right in a cohabitation agreement, or if it isn't otherwise modified in a cohabitation agreement, then you can apply for partner support and child support, which may help you afford the loan and insurance.

A lawyer can help you to figure out what you're entitled to. Since you aren't working, you might qualify for Legal Aid coverage. If you contact a lawyer who does Legal Aid work they can help to see if you qualify. Or if Legal Aid doesn't provide coverage (for example if your assets are worth too much or you start working and exceed their minimums), you might qualify for Edmonton Community Legal Centre (ECLC) coverage. ECLC also puts on a presentation about support that you might find helpful.
