Remove Child's Lawyer

Interested in hiring lawyer on limited scope to protect child. Age 12. Went no contact with one parent in sep 2024 and remains no contact. Other parent refuses to provide consent for child to choose therapist. Police Enforcement clause on order but Police spoke with child on 7 attempts for other parent to enforce parenting and they advised will not enforce due to child's verbal disclosre about abuse. Enforcement of parenting order application in court was heard and Judge did NOT order enforcement. Custodial parent requested lawyer for child- Judge ordered this through legal aid. Child's lawyer misrepresented them in court and requested a PN7 against child's informed consent, child will NOT work with psychologists whom are court ordered as they were already forced by the courts to see lawyers that the other parent forced on them. Efforts to protect child's psychological well being by custodial parent are being miscontrued in court as Alienation, other parent's historical abusive conduct is not being addressed for reasons regarding no contact-Stalled divorce action. Lawyer severely messed up and child wants to remove contact but is unable to without a court order. Looking to hire limited scope lawyer to put divorce matters back on track and table parenting matters. Other parent pushing for Trial, custodial parent wanting to avoid any further proceedings, avoid further legal abuse. No separation order, no Prenuptial order, highly combative parent accusing custodial primary caregiver of alienation. Could the custodial parent remove consent without an order and apply for a Binding JDR?

Hi Cindy, I am sorry to hear you are experiencing this turmoil, but a public forum such as this one is not the right place to address your concerns. If you have serious complaints about a lawyer's conduct, then you contact the Law Society of Alberta. If, however, this is a matter of just not liking what you hear, then you have to just let it all play out.

There is a whole new approach to family law coming in January 2026 with the Court of King's Bench called the Family Focused Protocol. As lawyers, we do not know all of the details (we have an education session later this month), but it is sort of like "one family/one judge" where a single judge will be assigned to work with a family through all preliminary and interim steps. You may want to wait to get into that new stream. In the meantime, I would encourage you to find a lawyer to speak with privately about your very specific situation. There is a list of lawyers who take limited scope retainers in the top left corner under "Directory."
