Child Support

Annually we recalculate child support payments based on our income tax return. When adjusting payments, do I include spousal support as part of my income to determine an updated child support calculation?

Spousal Support is generally included with total income for the purposes of calculating proportionate shares of special expenses under Section 7 of the Guidelines, such as child care costs or medical/dental expenses. Spousal support would not normally be included in calculating the base monthly child support amount.

It is always best to get advice from a lawyer on your unique circumstances. You can also make use of neutral mediators to assist in recalculation.
