Can I ask my ex for child support?

Cristi Adams (Calgary)

My husband and I were married for 8 years. We separated in 2022, at the time of separation had two bio kids and one kinship son with CFS. CFS closed the kinship home with both of us, and redid the home study with just myself - my ex was not allowed to be kinship to him and had to be supervised during visits. We share custody of our two bio kids 50/50 and in 2025 I obtained full private guardianship and sole custody of our kinship son. I would like to know if I could ask him for child support. We are still legally married but are separated. The child has known him since infancy and still calls him Daddy. I still get SFP but CFS no longer covers daycare costs and it would help to have help. Does he still have parental responsibility?

Because lawyers need sufficient information to be able to provide an opinion, and to be able to ask you questions (which usually means at least a half-hour consultation), the lawyers here can only provide basic information and answer very general questions. Please contact a lawyer directly through the Search to seek assistance with your matter. Thank you for your understanding.

Yes, of course you can ask for child support. Anyone with care and control of a child can ask for child support. However, it sounds like your situation is a bit more nuanced and would benefit from a private conversation with a lawyer.
