Childrens' Education

Anna (Calgary)

I am a SAHM of 5 years, married for 10. Both kids have delays. 1 is autistic and the other potentially autistic. My grade 1er attends a 50% homeschool and 50% normal school right now.

In order to register both kids for this school, I need my husbands' signature on the forms. In order for him to sign the school forms, he wants me to sign a document stating that I will never pursue or accept money or any other support from him as long as I make the educational decisions for the kids until grade 6.

My question is, does that mean if we were to get divorced or seperated, I am waiving my rights to Child Support from him? Is that legal to do so? I do not care about the spousal support.

It is against the law to bargain away child support like this. You don't have to do it. Go to court and ask for an Order granting you sole decision-making rights for your kids, and specifically, the right to enroll your kids in school without their father's consent. You may be eligible for a lawyer through Legal Aid Alberta.
