Filing Desk Divorce via Email

Megan (Edmonton)

Are desk divorce packages filed via email? I want to limit the time I have to take off work to go to the court house, so I am wondering if joint divorce forms can be filed via email. The website instructions (https://www.albertacourts.ca/kb/resources/announcements/new-email-filing-procedure) are unclear to me.
Thank you.

Yes, the Alberta Courts website is a bit confusing. Lawyers and law firms have e-filing and digital portal accounts to pay the associated filing fees, but individuals have to attend in person. Your first stop, though, is a different office, not the courthouse.

From the Alberta Courts website:

If you are representing yourself, please attend a Court and Justice Services office to have your Statement of Claim for Divorce with Children (and all copies) reviewed by Court and Justice Services for accuracy. Once Court and Justice Services confirms your application is satisfactory, you may file your application with Court and Justice Services using Interac, Visa or Mastercard. If you need to file using cash payment, you may attend thereafter at the Court of King's Bench.

Further information on this service and locations can be found on the Court and Justice Services (CJS) website.

I believe only lawyers and legal assistants can file by email. You could check with the Courthouse. You could postal mail your documents in. However, clerks review at the counter for obvious errors so that's a benefit and also there is a fee to be paid.
