Stay of enforcement on arrears

Lindsay Smith (Sylvan Lake)

How do I go about getting a stay of arrears "lifted" ? It was supposed to be 3 months, then it was 9 months. It's been 5 years and I still can't get a straight answer. Also the order was filed outside the jurisdiction of the children, which is 6 hrs away from me.

Usually you'd apply to vary a stay of enforcement as you would with any other court order. Whether that would be successful depends on the wording of the Order and the reason for the stay. You might need to speak to a lawyer and have them look at the Order. There's a directory of lawyers who can be consulted on our home page: https://albertalegal.org/index.php
