Spousal support

Does the plaintiff initiate all court appearances or can I make an application for spousal support even though I did not indicate that on my Statement of Defence. (not a Counterclaim).

Hi Ross,

In general, if you want to ask the Court to grant you any relief, you have to make a claim for it. The Statement of Defence is not a claim document. You probably have to file a Counterclaim, unless the originating Statement of Claim asks for spousal support for the Defendant. Going over the filed documents with a lawyer would be the best first step to get advice as to the options specific to your case.
